INSIGHTS INTO THE BULDING INDUSTRY

Welcome to the world of dangerous cladding, water ingress, and substandard building


The Lacrosse building fire in Melbourne in November 2014, brought the issue of combustible cladding to the forefront in Australia, particularly in Victoria. The fire, which spread rapidly due to aluminium composite panel (ACP) cladding with a polyethylene core, highlighted significant systemic failures in the building and construction industry, including issues with product compliance, building certification, and regulatory oversight. 


This event was a precursor to the Grenfell Tower tragedy in London in 2017, further emphasizing the global scale of the problem. Following the Lacrosse fire, numerous buildings across Victoria were identified as having similar non-compliant cladding, leading to a widespread crisis that has left many innocent consumers facing substantial financial burdens and significant mental distress. 


The rectification costs for removing and replacing dangerous cladding can run into millions of dollars per building, often falling on apartment owners who purchased their properties unaware of the inherent risks. This has resulted in special levies, increased insurance premiums, and a devaluation of properties, trapping many owners in a state of financial precarity and emotional turmoil. 


The Victorian Government has acknowledged the severity of the cladding crisis and has implemented various initiatives to address it. One of the most significant responses has been the establishment of Cladding Safety Victoria (CSV) in 2019. CSV is a dedicated agency tasked with identifying, assessing, and facilitating the rectification of high-risk combustible cladding on residential buildings. 

The Victorian Government has committed over $600 million to the statewide cladding rectification program, aiming to remove and replace dangerous cladding on hundreds of buildings This funding is crucial in alleviating some of the financial burden on owners, though it does not cover all costs, and the process can be lengthy and complex. 


Furthermore, the government has introduced legislative reforms to strengthen building regulations, improve compliance, and hold responsible parties accountable These reforms include amendments to the Building Act 1993 and new regulations aimed at preventing future cladding issues and enhancing consumer protection. Despite these efforts, the scale of the problem means that many buildings are still awaiting rectification, and the emotional and financial toll on affected residents continues to be a significant concern. 


My 35 years of active experience in the building industry, including working with various governments and, more recently, with the Victorian Government on industry reform, I am uniquely positioned to assist in navigating this complex issue and contributing to positive outcomes for affected consumers. My expertise could be invaluable in several areas:


Understanding the Regulatory Landscape My understanding of the Building Act 1993 (Vic), the Building Regulations 2018 (Vic), and the Victorian Building Authority (VBA/BPC's role would be critical. 

I could explain how these regulations have evolved in response to the cladding crisis and how they impact rectification efforts. For instance, I could detail the Ministerial Directions issued by the Victorian Minister for Planning regarding combustible cladding and their implications for building owners and practitioners. 


Navigating the Cladding Safety Victoria (CSV) Process

I could provide guidance on the application process for CSV funding if still available, the criteria for eligibility, and what building owners can expect during the assessment and rectification phases. My experience could help demystify the often-intimidating bureaucratic procedures, offering practical advice on how to effectively engage with CSV and other stakeholders.


Technical Aspects of Cladding Rectification

My industry experience would allow me to explain the technical complexities of cladding removal and replacement, including the different types of non-compliant cladding (e.g., ACP, expanded polystyrene (EPS)), the appropriate replacement materials, and the engineering challenges involved. I could also shed light on the importance of fire engineering reports and building permits in the rectification process. 


Advocating for Affected Consumers

With my background in working with government, I could effectively advocate for the rights and interests of innocent consumerscaught in this fiasco. This could involve explaining the legal avenues available to them, such as pursuing claims against builders, developers, or certifiers, or understanding the limitations of existing compensation schemes. Your insights into government processes could help shape policy discussions and push for more comprehensive solutions.


Industry Reform and Future Prevention

My involvement in industry reform efforts would enable me to discuss the lessons learned from the cladding crisis and the ongoing initiatives to prevent similar issues in the future. This could include insights into proposed changes to building codes, improved oversight mechanisms, and enhanced accountability for building practitioners. I could highlight the importance of due diligence for future property purchasers and the need for greater transparency in the building industry.


Mediation and Resolution

My extensive experience could also be leveraged in mediating disputes between owners corporations, builders, and other parties involved in the rectification process. My understanding of industry practices and government expectations could facilitate constructive dialogue and help achieve equitable outcomes, reducing the mental and financial strain on affected individuals.
